On June 29, 2021, the state of California passed Assembly Bill 832. AB 832 implemented new procedures for nonpayment of rent notices and evictions for rent due from October 1, 2021, through March 31, 2022 (COVID-19 Recovery Period Rental Debt). On or after October 1, 2021, to evict a tenant for nonpayment of COVID-19 Recovery Period Rental Debt, the landlord must comply with the following requirements:
- Tenant must be served a nonpayment of rent notice of no less than three days excluding Saturday, Sunday or Judicial Holidays that complies with the requirements in Civil Code 1179.10(a).
- Landlord must have applied for rental assistance to cover the rental debt demanded in the eviction.
- Twenty days must have passed since Landlord applied for rental assistance and the Landlord has not received notice or obtained verification from the rental assistance program indicating the tenant has submitted a completed application to cover rental debt in the eviction.
Additionally, the Court can dismiss your case at any time before possession is restored if the tenant can prove the following:
- The rental debt in the eviction accumulated due to COVID-19 financial hardship.
- The Tenant submits verification to the Court that a governmental rental assistance program has approved an application for rental assistance for part or all of the rental debt demanded in the complaint.
- The approved payment from the rental assistance program, together with any additional payments made by the tenant, constitute a full payment of the rental debt in the eviction.
If you plan on filing an eviction for rent prior to October 1, 2021 you should meet with an attorney prior to serving any additional notices.
