On March 31, 2022, California passed Assembly Bill 2179 into law. This law extends eviction protections for tenants who 1) completed a rental assistance application on or before March 31, 2022 or 2) paid 25% of their rent payments from September 1, 2020 through September 30, 2021 and signed and returned all declarations of COVID-19 related financial distress.
This law continues to complicate the eviction process for nonpayment of rent from September 2020 through March 31, 2022.
We advise that if your tenant fails to pay April 2022 rent by the due date you can serve them the notice linked below the day after the rent is due. We recommend only demanding April 2022 rent on this notice.
If your tenant still owes you rent from any period before April 2022 we recommend filing a small claims lawsuit to recover this rent.
The best way to make sure that you have a successful eviction is to obtain legal counsel prior to serving a legal notice. Please give our office a call to discuss your matter further.
