Additionally, we want to caution you against working up a payment agreement/separate contract that is not an addendum to your current rental agreement or lease. Creating a separate agreement may limit your ability to recover the unpaid rent through the eviction process and force you to file a small claims action or other lawsuit. 

We have seen several form payment agreements that landlords may download for free.  We do not suggest executing any new agreement with your tenant without discussing the legal implications with an attorney.

The San Diego Superior Court will remain closed through April 30, 2020.  The court is now tentatively scheduled to reopen May 1, 2020. All non-emergency civil matters will be recalendared for a later date.  We will continue to provide you with updates as to court operations as we become aware of them.
